JUDGES are NOT 'the Law'

JUDICIAL OFFICIALS are hired by us, and trusted, to HONOR the Law

Judges have a DUTY to be LAW ABIDING in the performance of their function

Unfortunately, many of who we, the public / people, have trusted to be Judicial Officials refuse to be honorable and, as a result, have brought our entire system of justice, our system of law, our government, and our society, into disrepute. We can only correct his by knowing the Law that governs their functions. The Law that apply directly to the Judge in a trial court and to the panel of Judges in Appellate and Supreme Courts.

1. The Code of Judicial Conduct - the Cannons.

2. Court Rules - Rules of Civil Procedure, Rules of Criminal Procedure, and other Rules the Judicial Officials establish to govern their own conduct.

3. Our Organic Law and our Constitutions.

4. Statutory Law of Congress and State legislative bodies to the extent they conform to Organic Law and Constitutional Law.

ALL of the foregoing are LAWS that every Judicial Official has a DUTY to know, and to comply with, for 'good behavior'.

'Power to Interpret'

NO - it is a DUTY to understand. A Obligation to be COMPETENT

Judicial Officials routinely violate the Law that governs their behavior. They do so under the claim they have been given the "power to interpret". This phrase "power to interpret" is taken from a case written by our First Supreme Court for our United States in 1793. But if you read the case you find that the First Chief Justice of our First United States Supreme Court did NOT say Judges have a "power" to interpret. Rather, he said that Judges have a DUTY to UNDERSTAND the Law, and to EXPLAIN the Law to those who might not. In other words, they have a DUTY to explain (interpret) how they came to their decision to apply the relevant law to the material facts of a case.

Justice Marshall, in the Opinion of Marbury v. Madison, was VERY CLEAR that ours is a Nation under THE RULE OF LAW.

AND that that means that JUDGES are BOUND by the law, even if the President of the United States, as in the case of Marbury v. Madison, wants to violate the Law and wants the Judges of our Supreme Court to permit him to violate the law.

The word 'interpret' means "to understand". This definition of the word 'interpret' has not changed from that time to the present. Just as an 'interpreter' of a foreign language is able to UNDERSTAND that language, and EXPLAIN the meaning of that language to those who do not. The Interpreter has a DUTY to understand, as well as the ability, to give the PROPER understanding.

Under the American and Texas System of Law and Government the people do NOT give "power". We give DUTIES, and we give PERMISSION, and we give RESPONSIBILITIES, and OBLIGATIONS to our Public Servants. For this they are paid from our Tax Dollars. We did NOT elect them, appoint or hire them through our those we elected to represent us, to be GOD or KING standing in for God with the 'divine right' to rule arbitrarily can capriciously with whatever Law they choose to create.

INDEPENDENT JUDICIARY

An 'Independence Judiciary' is a fundamental characteristic of a Republican Form of Government and essential to a Democracy. But the phrase 'Independent Judiciary' does NOT mean Judicial Officials are above the law, or "independent" of the Law. It means Judges have a DUTY to rule independently of how the Executive Division of Government, and its Actors, may want. It has a duty to hold these actors in check. It has a duty to make Government, and its Actors, law-abiding.

An 'Independent Judiciary' is independent of Legislative Bodies of a State, and our US Congress, if the laws (statutes) created by these representatives of the sovereign violate the Law of the Sovereign of this Land (the People) expressed in the supreme Law of the Land - our Organic Law and Constitutions.

If the Judiciary does not exercise its duty to be independent of the Executive and Legislative Departments of Government then we no longer have a republican form of government and our democracy has been lost to usurpers. We are no longer a free people but an enslaved people. Our public servants are no longer our servants but have become our slave masters.
