NOW COMES EDMUND B. HEIMLICH, Defendant pro se, to request the money in the amount of $5,050 (Five Thousand Fifty Dollars) currently held by Katherin Tyra, District Clerk, be transfered to the registry of the Harris County Civl District Court 157 to be held there until settlement of cause numbered 94-000171 and, for cause thereof will respectfully show the court;

I.

That the money was unlawfully seized or seized by mistake.

II.

That the money is not owned by the complainant, Eric Pettorino, but; by virtue of contract between the complainant and Choice Realty Partners, whose designated broker is Edmund Heimlich, is the subject of a civil contract dispute between Eric Pettorino and Edmund Heimlich.

III.

That the original check for the funds siezed was issued to Edmund Bryan Heimlich as evidenced by the attached exhibit, a true and correct copy of the original check.
